Updated Codes of Practice on preventing illegal working published

The government has published updated Codes of Practice on preventing illegal working, and on avoiding unlawful discrimination while preventing illegal working, both of which will come into force from 6 April 2022.
The Codes of Practice include several changes and additions to reflect forthcoming changes to right to work checks from 6 April 2022. For example, the Code of Practice on preventing illegal working now contains:
reference to the option of some right to work checks being carried out using new Identity Document Validation Technology (IDVT) via the services of an Identity Service Provider (IDSP)
updates to the lists of acceptable documents for manual right to work checks
confirmation that, from 6 April 2022, biometric residence card, biometric residence permit and frontier worker permit holders are only able to evidence their right to work using the Home Office online right to work checking service.
The Code of Practice on avoiding unlawful discrimination while preventing illegal working includes additional guidance on fair recruitment processes when carrying out right to work checks.
