New employment tribunal statistics show ongoing increase in claims

The government has published its annual employment tribunal and employment appeal tribunal (EAT) statistics tables for the financial year 1 April 2018 to 31 March 2019. The government’s statistics tables show that the number of accepted employment tribunal claims in 2018/19 was 121,075, comprising 34,974 single claims and 86,101 multiple claims. This represents a 10% increase compared to 2017/18 which saw 109,698 claims accepted. The annual statistics also show that:
- 49% of all cases were withdrawn or settled before a tribunal hearing, 12% were struck out by the tribunal without a hearing, 16% were dismissed by the tribunal upon withdrawal, 11% were disposed of through a default judgment or dismissed at a preliminary hearing, 2% had the case discontinued, 1% were unsuccessful at tribunal hearing and 9% were successful at tribunal hearing
- 64.5% of claimants had legal representation at tribunal, with a further 4.1% being represented by their trade union
- the maximum unfair dismissal award was £947,585 and the average (mean) award was £13,704
- the maximum race discrimination award was £33,660 and the average award was £12,487
- the maximum sex discrimination award was £24,103 and the average award was £8,774
- the maximum disability discrimination award was £416,015 and the average award was £28,371
- the maximum religious discrimination award was £12,000 and the average award was £4,767
- the maximum age discrimination award was £172,070 and the average award was £26,148
- no awards were made in respect of sexual orientation discrimination
- costs were awarded to the claimant in 51 cases and to the respondent in 158 cases and the average costs award was £6,729
- the EAT received 1,291 appeals, but 646 of these were rejected at the sift stage as having no reasonable prospect of success or as being out of time.
