Government consults on amending the Code of Practice for employers

The government has issued a consultation seeking views on proposed amendments to the Code of Practice for employers on avoiding unlawful discrimination while preventing illegal working. It has produced a revised version of the Code of Practice which is intended to apply to all employment commencing on or after 6 April 2022, and to repeat checks on existing workers required to be carried out on or after that date to retain the statutory excuse.
The consultation is aimed at employers and those who undertake right to work checks on an employer’s behalf, such as recruitment agencies. The revised Code of Practice covers what discrimination is and how to avoid it, focussing on such areas as unlawful race discrimination in employment and fair recruitment processes for those with an entitlement to work in the UK.
The consultation period is short and closes on 25 February 2022.
