The Information Commissioner’s Office (ICO) has published detailed guidance for organisations, explaining data protection now that the UK has left the EU. The publication of the guidance follows the European Commission adopting two adequacy decisions under the EU GDPR and the Law Enforcement Directive, allowing personal data to continue to flow freely from the EU and EEA to the UK without additional safeguards.

The guidance is particularly relevant to UK businesses and organisations that target European customers or operate inside the EEA. It is aimed primarily at Data Protection Officers and those with specific data protection responsibilities and covers:

 

  • adequacy
  • the UK GDPR – international data transfers, European representatives, UK representatives, EU regulatory oversight and other actions to take
  • law enforcement processing.
