The Statutory Sick Pay (Coronavirus) (Funding of Employers’ Liabilities) (Closure) Regulations and the Statutory Sick Pay (Coronavirus) (Funding of Employers’ Liabilities) (Northern Ireland) (Closure) Regulations 2021 have been laid before Parliament and will come into force on 30 September 2021.

The effect of the regulations is that eligible small and medium size employers will no longer be able to use the Coronavirus Statutory Sick Pay Rebate Scheme to reclaim up to two weeks of coronavirus-related statutory sick pay (SSP) costs per employee. This means that the funding of SSP for employee absences related to COVID-19 occurring on or after 1 October 2021 will revert to being met entirely by the employer. 

All claims to the Coronavirus Statutory Sick Pay Rebate Scheme relating to employee absence periods up to and including 30 September 2021 must now be made by no later than 31 December 2021.
